Image & Video Terms

PLEASE READ THESE SERVICE-SPECIFIC TERMS CAREFULLY.

These Image & Video Terms (“Service Terms”) supplement your (“you”, “your” or “Customer”) existing agreement with ElevenLabs or, if no separate agreement exists, the ElevenLabs Terms of Service (either, the “Underlying ElevenLabs Agreement”). Your use of Image & Video (defined below) is also subject to our Prohibited Use Policy and our Privacy Policy, where applicable. Defined terms used in these Service Terms have the meanings set forth in the Underlying ElevenLabs Agreement.

Please read these Service Terms carefully. By using Image & Video, you agree to these Service Terms. If you do not agree or do not have the authority to agree, you are not permitted to use Image & Video. These Service Terms constitute a legally binding contract between you and ElevenLabs. In case of any conflict between these Service Terms and other terms agreed upon between you and ElevenLabs, these Service Terms shall prevail with respect to your access or use of Image & Video. 

THESE SERVICE TERMS CONTAIN VARIOUS LIMITATIONS AND EXCLUSIONS OF LIABILITY IN SECTION 6.

1. IMAGE & VIDEO SERVICES. “Image & Video” is a tool offered by ElevenLabs that enables the generation, editing, and transformation of images and videos as part of ElevenLabs’ Services. Image & Video is powered in part by one or more third party model providers (“Third-Party Providers”). 

By using Image & Video, you acknowledge and agree that information submitted to the Services may be processed by Third-Party Providers as necessary to provide the functionality of Image & Video. Your use of Image & Video may also be subject to applicable terms, policies, or restrictions imposed by such Third-Party Providers. You represent and warrant that you will not submit any Input that is prohibited under these Service Terms, the Prohibited Use Policy, applicable law, or applicable Third-Party Provider requirements. 

Third-Party Providers are independent third parties and may modify, suspend, restrict, or discontinue their services at any time. ElevenLabs may add, remove, or replace Third-Party Providers at any time in its sole discretion.

2. SHARING OF IMAGE & VIDEO OUTPUT.  ElevenLabs may allow you to share Output publicly, including in our image or video galleries, such as the Explorer or Library. If you choose to share such Output (“Shared Output”), you hereby grant to ElevenLabs a worldwide, royalty-free, fully paid-up, transferable, and sublicensable (through multiple tiers) license to use, reproduce, modify, adapt, publish, translate, create derivative works of, distribute, publicly perform and display, and otherwise exploit the Shared Output for any lawful purpose. Such purposes may include operating, maintaining, improving, and enhancing the Services; developing new products and services; and conducting marketing, promotional or other commercial activities, whether by ElevenLabs or its third party sublicensees. 

If you opt in to share your Output publicly, you may later opt out of the sublicensing of your Output to third parties (including making them available to other ElevenLabs users) at any time by using the "Disable" functionality available in the Image & Video product settings. Upon processing of such opt-out request, your Output will no longer be made available for new third-party use; however, this will not affect any sublicenses or uses already granted or commenced prior to the effective date of your opt-out. 

3. PROHIBITED CONDUCT. You may not upload, generate (through Image & Video), or share any content that violates the Prohibited Use Policy, or otherwise use Image & Video to:

  • assist in identifying any person or to solicit or infer private or sensitive information about an individual;
  • Reproduce or generate the likeness of any person under 18;
  • upload, submit, or transmit content that contains, or that you know or reasonably expect contains, sensitive personal data, restricted data, or other information prohibited by applicable law, regulation, governmental order, ElevenLabs policies, or applicable Third-Party Provider requirements, including biometric identifiers, government-issued identifiers, financial information, health information, precise geolocation data, or other sensitive personal data relating to US persons;
  • create, distribute, or promote sexually explicit, violent, hateful, or harmful content; or
  • generate Output that contains sensitive personal information.

    We may, in our sole discretion, permit exceptions to these policies when justified by educational, documentary, scientific, artistic, journalistic, or public-interest purposes.

4. REPORTING VIOLATIONS. If you encounter content that you believe violates any of our policies, please report it immediately⁠ using this form. We take all violations seriously and will review reported content for compliance with our Terms of Service and Prohibited Use Policy. 

5. FEES. Unless otherwise agreed in writing, you acknowledge and agree that ElevenLabs will charge the Fees for Image & Video set forth on our pricing pages available at https://elevenlabs.io/pricing or https://elevenlabs.io/scale-tier, or as otherwise displayed within the Service interface (including the prompt box), as applicable. All Fees are subject to change in accordance with the Underlying ElevenLabs Agreement or as otherwise communicated to you by ElevenLabs in writing.

6. EXCLUSION OF UNDERLYING INDEMNITY; THIRD-PARTY PROVIDERS. Notwithstanding anything to the contrary in the Underlying ElevenLabs Agreement, any indemnity provided by ElevenLabs in respect of third-party intellectual property infringement shall not apply to or in connection with your access to or use of Image & Video, including any Output generated therefrom. 

To the maximum extent permitted by law, ElevenLabs shall have no liability arising from or relating to any Third-Party Provider, including any act, omission, outage, interruption, delay, degradation, suspension, discontinuation, security incident, policy change, legal violation, or Output generated or provided by such Third-Party Provider.

7. AVATARS. 

A. Definitions. “Avatars” are digital representations of humans or animated characters made available through the Services. Avatars include: (i) "Stock Avatars," which are made generally available by ElevenLabs through the Services; and (ii) "Custom Avatars," which are Output generated from your Input.

B. Use of Avatars. You may access and use certain Stock Avatars that we make generally available through the Services and may generate Custom Avatars through the Services. 

C. Stock Avatars. Subject to the Underlying ElevenLabs Agreement and these Service Terms, ElevenLabs permits you to use Stock Avatars solely in connection with your use of the Services and any Output generated through the Services. ElevenLabs may modify, suspend, remove, or discontinue any Stock Avatar at any time without notice. You may not sell, sublicense, distribute, make available, or otherwise exploit Stock Avatars on a standalone basis outside the Services; provided that nothing in this Section restricts your use of Output incorporating Stock Avatars as otherwise permitted under the Underlying ElevenLabs Agreement.
